Agreement to Terms
By accessing or using Ember ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Ember for your personal, non-commercial use.
User Account
To use Ember, you must sign in with Apple. You are responsible for:
- Maintaining the security of your Apple ID
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
Acceptable Use
You agree not to:
- Use the App for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's operation
- Reverse engineer, decompile, or disassemble the App
- Use automated means to access the App without permission
- Share your account credentials with others
Subscriptions and Payments
Premium Subscription
Ember offers premium subscriptions with additional features. All purchases are processed through Apple's App Store and are subject to Apple's Terms of Service.
Auto-Renewal
Premium subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID Account Settings.
Refunds
All purchases are final. For refund requests, please contact Apple Support, as all payments are processed through the App Store.
Recovery Tokens
Premium subscribers receive 3 recovery tokens per month. Additional tokens may be purchased as consumable in-app purchases. Tokens do not roll over between billing periods.
Intellectual Property
Ember and all related materials, including but not limited to software, graphics, logos, and content, are the property of Ember or its licensors. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
User Content
You retain ownership of any goals and data you create in Ember. By using the App, you grant us a limited license to store and process your content solely to provide the service. We will not share your goals or personal data with third parties except as described in our Privacy Policy.
Disclaimer of Warranties
EMBER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE APP IS AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Indemnification
You agree to indemnify and hold harmless Ember and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.
Termination
We reserve the right to suspend or terminate your access to Ember at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your license to use the App will immediately cease.
Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ember operates, without regard to its conflict of law provisions.
Apple Terms
If you downloaded Ember from the Apple App Store, you acknowledge and agree that:
- These Terms are between you and Ember, not Apple, and Apple is not responsible for the App or its content
- Apple has no obligation to provide maintenance or support services for the App
- Apple is not responsible for any product warranties
- Apple is not responsible for addressing any claims you or third parties have relating to the App
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you
